Terms of Service

This draft is written to match how Phin actually works today. It has not been reviewed by a lawyer — get that review, fill in the bracketed placeholders below, and remove this notice before it goes live.
1. Who you're agreeing with
Phin ("Phin," "we," "us") is currently operated by [Your full legal name / entity once incorporated], an individual based in France. Phin is not yet incorporated as a company. If you incorporate later, this section should be updated to name the entity and its registered address.
By joining the waitlist, creating an account, or using the Phin app (web or mobile), you agree to these Terms. If you don't agree, don't use Phin.
2. What Phin is
Phin is a coffee companion app for logging brews (dose, yield, grind, temperature, time), rating and tagging flavor, tracking how your palate changes over time, and getting AI-assisted insights and bean/recipe recommendations ("Palate Intelligence"). Phin is currently in pre-launch: the public site collects waitlist signups, and the full app is available to signed-up users. Features may change, and we may add, remove, or modify them at any time as the product develops.
3. Eligibility
You must be at least 16 years old to use Phin. By using Phin, you confirm you meet this requirement.
4. Your account
You're responsible for keeping your login credentials secure and for all activity under your account. Tell us right away if you suspect unauthorized access. You can request deletion of your account and data at any time from the app's Privacy Center — see our Privacy Policy.
5. Your content
You keep ownership of what you enter into Phin — brew logs, tasting notes, ratings, bean photos, and anything else you add ("Your Content"). By submitting Your Content, you give us a license to store, process, and display it back to you as part of running the service, and to use it to generate the AI insights, recommendations, and recipe suggestions you request. We don't claim ownership of Your Content and won't sell it.
Some features (bean-bag scanning, recipe suggestions, brew analysis, and the tasting insights) send relevant parts of Your Content to a third-party AI provider to generate a response — see the Privacy Policyfor which provider and what's sent. Don't submit content you don't have the right to share, or that contains someone else's personal information without their consent.
6. Acceptable use
Don't use Phin to:
- Break the law, or infringe someone else's rights.
- Try to access another user's account or data without permission.
- Interfere with or disrupt the service (scraping at scale, overloading our infrastructure, reverse-engineering the app beyond what the law allows).
- Upload malicious code, or content that's abusive, deceptive, or harmful to others.
We can suspend or terminate accounts that violate this section.
7. Hardware integrations
Phin can connect to compatible espresso hardware (currently Gaggimate-compatible machines) over your local network to read shot data. We're not responsible for the operation, safety, or maintenance of your physical equipment — that's between you and the hardware manufacturer.
8. No warranty
Phin is provided "as is." We're a pre-launch, actively-developed product — AI suggestions (recipes, insights, recommendations) are generated automatically and may be wrong; use your own judgment, especially around anything involving hot water, pressure, or equipment settings. We don't guarantee the service will be uninterrupted, error-free, or available at all times.
9. Limitation of liability
To the extent permitted by law, Phin and its operator aren't liable for indirect, incidental, or consequential damages arising from your use of the service. Nothing in these Terms limits liability that can't legally be limited (for example, liability for gross negligence or willful misconduct under French law).
10. Changes to these Terms
We may update these Terms as Phin develops. We'll update the "Last updated" date above; material changes will be flagged in the app or by email where required.
11. Governing law
These Terms are governed by French law. Any dispute that can't be resolved informally will be subject to the exclusive jurisdiction of the French courts, without prejudice to any mandatory consumer-protection rights you have in your own country of residence if you're an EU consumer.
